1. Who we are

Lucim Polls (“Lucim”, “we”, “us”) is a digital voting and ticketing platform operated from Nairobi, Kenya by IMAKEL SYSTEMS, a business registered in Kenya. These terms are a binding agreement between you and IMAKEL SYSTEMS. By browsing the platform, casting a vote, buying a ticket, or creating an organizer account, you accept these terms.

2. What Lucim is (and is not)

Lucim is a platform. Events on Lucim (pageants, concerts, awards, talent shows) are created, owned and run by independent organizers, not by us. The organizer is responsible for their event: its content, its schedule, its contestants, whether it takes place, and how its results are used. We provide the technology for voting, ticketing, payments and check-in.

3. For fans: voting

• Paid votes support a contestant in an organizer's event. A vote is final once submitted and is not refundable, including if your contestant does not win or if the event is later changed, postponed or cancelled.
• Voting is not a lottery, raffle or game of chance, and buying votes gives you no chance of winning anything. It is a way of supporting a contestant.
• Prices per vote are set by the organizer and shown before you pay.
• We work to keep vote counts accurate and tamper-free, but final results, prizes and any decisions based on results belong to the organizer.
• Do not use automation, fraudulent payments, or other manipulation to vote. We may void votes that we reasonably believe are fraudulent.

4. For fans: tickets

• Tickets are sold on behalf of the event's organizer. Your ticket contract is with the organizer; Lucim processes the sale and delivers your digital ticket with its QR code.
• Keep your QR code private. Anyone with the code may be admitted in your place; duplicated codes are rejected at the gate.
• If an event is cancelled and not rescheduled, you are entitled to a refund of the ticket price from the organizer, and we will facilitate that refund from the organizer's event funds. Processing fees may not be refundable.
• If an event is postponed or changed, your ticket remains valid for the new date unless the organizer states otherwise.
• Except as described above, tickets are not refundable and resale for profit is not allowed.

5. Payments

Payments are processed through M-Pesa, Airtel Money and card providers. By paying you confirm the payment method is yours to use. Reversed or fraudulent payments may lead to votes being voided, tickets being cancelled, and accounts being suspended.

6. For organizers

• You must give accurate information when onboarding, and keep your account credentials safe. You are responsible for everything done under your account.
• Platform fees follow the rates published on our pricing page at the time of each transaction. Fees are deducted before payouts.
• You own your event and are responsible for running it as advertised, including delivering the event, honouring announced prizes, and funding ticket refunds if you cancel.
• For every poster, photo or other content you upload, you confirm that you have the right to use it and, for photos of contestants or other people, that the person has consented to appearing on the platform.
• Events that are unlawful, deceptive, hateful, or that we reasonably consider harmful to the platform are not allowed, and we may remove them.
• We may withhold payouts connected to suspected fraud, chargebacks or unresolved refund obligations while we investigate.

7. Acceptable use

Do not interfere with the platform's operation, attempt to access other users' data, scrape the platform, or use it for any unlawful purpose. We may suspend or terminate access for breach of these terms.

8. Intellectual property

The Lucim platform, its design and its software belong to us. Content uploaded by organizers belongs to the organizer (or their licensors); by uploading it they give us permission to display and promote it on the platform.

9. Liability

We provide the platform with reasonable skill and care, but we cannot promise it will always be available or error-free. To the extent the law allows: we are not liable for the acts or omissions of organizers (including cancelled events or disputed results); and our total liability to you for any claim is limited to the amount you paid through the platform in the transaction giving rise to the claim. Nothing in these terms limits liability that cannot lawfully be limited.

10. Changes and termination

We may update these terms as the platform evolves; the “last updated” date above will change and significant changes will be highlighted on the platform. Continued use after a change means you accept it. You may stop using Lucim at any time.

11. Governing law and disputes

These terms are governed by the laws of Kenya, and disputes are subject to the courts of Kenya. Before going to court, contact us first. Most issues are resolved quickly by talking to us directly.
